At the beginning of 2022, the law regarding DUI diversion changed. DUIs are no longer eligible for diversion in California. Appeals are currently pending, which will hopefully reverse that decision to exclude DUIs from diversion. If successful, diversion would once again be applicable to DUIs in California. According to the California Highway Patrol, a man got out of his disabled gray Scion when a suspected drunken driver in a white Toyota 4Runner struck him in the slow lane of the 101 near the Balboa Boulevard off-ramp.

A spokesman with the California Highway Patrol, Officer Leland Tang, said that there were 2 female passengers seated in the Scion. They both were transported to the hospital. 1 of the 2 females is in critical condition and the other suffered minor injuries in the accident. There was also a female passenger riding in the 4Runner who suffered non-life threatening injuries.

Police identified the driver of the 4Runner as 31-year-old Robert Graves. Officials said that Graves was locked up in a Los Angeles jail.
